Terms of Service


Zoomtherapy.com is owned by iCam Professional Services, Ltd.(“iCam”). iCam provides services for counselors and their clients. Use of ZoomTherapy.com is conditional on your agreement to abide by the following terms of service. Without this agreement, iCam, its affiliates and providers will not provide the services. PLEASE READ THIS CAREFULLY.

Terms of Service

iCam Professional Services, Ltd. provides its service to you as a registered user. This document is a binding agreement and we shall refer to it as the “TOS” (Terms of Service). The TOS comprises the entire agreement between iCam Professional Services, Ltd., its providers, and you, the User, superseding any prior agreements between you and iCam Professional Services, Ltd. with respect to its subject matter.

Limitation of Liability

iCam Professional Services, Ltd.’s sole responsibility is to provide you, the client with an Internet-video chat portal to a provider.

Due to the limitations of providing service over the Internet, NEITHER iCAM NOR ITS PROVIDERS ACCEPT ANY LIABILITY FOR THE EFFICACY OF THE COMMUNICATION OR SUITABILITY THEREOF. IF YOU ARE HAVING FEELINGS ABOUT HARMING YOURSELF OR OTHERS, PLEASE CONTACT YOUR LOCAL HEALTHCARE PROVIDER IMMEDIATELY.

User also acknowledges that while iCam Professional Services, Ltd. makes every effort to check the counselors’ credentials and experience, it is not responsible should these be found in error. Nor is iCam in anyway responsible for the activities and behavior of the provider. iCam however, will investigate any allegations of impropriety and will terminate any provider found, at iCam's sole discretion, to be acting unprofessionally.

Different locations have different jurisdictions. Neither iCam nor its providers can know with certainty your location. Therefore you agree that from a legal and administrative perspective, any use of this service by you shall be deemed to be equivalent to you being physically at the provider’s location, and that the applicable laws and regulations of that location apply to your communication with the provider. YOU SPECIFICALLY ACKNOWLDEGE THAT NEITHER iCam NOR ITS PROVIDERS OFFER ANY KIND OF ASSURANCE THAT THEY ARE QUALIFIED TO PRACTICE IN YOUR LOCATION OR JURISDICTION. IF YOU STILL WISH TO COMMUNICATE WITH THEM, YOU UNDERSTAND THAT THE PROVIDER WILL BE OFFERING THEIR SERVICES AS A LIFE COACH, AND NOT AS A PROFESSIONAL THERAPIST OR COUNSELOR.

The client accepts all risk as to the effectiveness of the treatment and specifically waives his/her right to legal action or to cancel the charge with the credit card company following a session, unless iCam is in breach of this agreement. The client accepts full responsibility for conducting the session in a safe environment. The client accepts full responsibility to provide the necessary equipment to conduct the on-line therapy session. Client agrees that regardless of any other limitations of liability, under no circumstances will iCam, its affiliates, or providers' liability exceed the amount paid by client. Client understands that iCam and its providers would not provide the service without that agreement.

Payment of Fees

All therapy session fees must be paid in full in advance. If you are paying fees in a currency other than the currency being charged, your bank or financial institution may impose fees for currency exchange and for international transactions. For example, Visa and MasterCard charge a 1% processing fee on international transactions, and most card-issuing banks add their own small additional fees, generally a percentage of your overall purchase price. Similar considerations apply for any other mismatch between the currency in which fees are quoted on the site and the currency in which you make your actual payments.

By scheduling a counselor session, you expressly understand and agree that the amount of the session fee will be charged against your credit card, debit card, or Direct Debit account. You warrant and represent that you have been made fully aware of, and that you give your express consent willingly and knowingly for such authorization for said such amount(s). These fees are prominently disclosed to you prior to your willing entrance into the fee-based chat interface. If iCam Professional Services, Ltd. does not receive payment from the credit or debit card issuer or its agents, or the bank authorizing the Direct Debit account, for your usage of iCam Professional Services, Ltd.’s service, you agree to pay all amounts due upon demand by iCam Professional Services, Ltd. Each time you use iCam Professional Services, Ltd. you agree and reaffirm that iCam Professional Services, Ltd. is authorized to charge your designated card or Direct Debit account. Your card issuer agreement or bank account agreement governs your use of your designated card or account in connection with iCam Professional Services, Ltd., and you must refer to that agreement and not this TOS with respect to your rights and liabilities as a card holder or as a holder of a bank account. If iCam Professional Services, Ltd. does not receive the full amount of your iCam Professional Services, Ltd. charges within thirty (30) days of the invoice date, an additional 1.5% (or the highest amount allowed by law, whichever is lower) per month late charge may be added to your bill and immediately become due and payable, at the sole discretion of iCam Professional Services, Ltd. You shall be liable for all attorney and collection fees arising from iCam Professional Services, Ltd.’s efforts to collect any unpaid balance of your account(s). You agree to be billed for and to pay any outstanding balance in the event of cancellation or termination of your iCam Professional Services, Ltd. account. Unless you notify iCam Professional Services, Ltd. of any discrepancies within thirty (30) days after they first appear on your account statement, they will be deemed acceptable by you for all purposes, including resolution of inquiries made by your card issuer or bank. You release iCam Professional Services, Ltd. from all liabilities and claims of loss resulting from any error or discrepancy that is not reported to iCam Professional Services, Ltd. within thirty (30) days of its publication.

iCam Professional Services, Ltd. RESERVES THE RIGHT, AT ANY TIME, TO CHANGE ITS FEES AND BILLING METHODS. Your continued use of iCam Professional Services, Ltd. following the effective date shall constitute your acceptance of such change.

You are responsible for all charges associated with connecting to iCam Professional Services, Ltd. You agree that any charges incurred to access the Internet, including but not necessarily limited to telephone charges and access fees billed by your Internet Service Provider, are entirely your responsibility. Depending on your particular location and chosen Internet Service Provider, you may be subject to long distance charges and/or other communication surcharges, which are your responsibility.

No sales tax will be added to published prices on these purchases.

Cancellation, Rescheduling, and Refunds

All requests for cancellations and rescheduling MUST be made more than 24 hours before the scheduled session by emailing support@zoomtherapy.com, or the full fee will be charged. Prior to 24 hours before the session, these changes may be made free of charge. Within 24 hours, or a failure to appear at the appointment will lead to the loss of the payment, since the counselor will not be able to schedule anyone else. You will be able to reschedule a new session at a 25% discount by emailing support@zoomtherapy.com.

In the event you experience technical difficulties prior to or during the session, please email support@zoomtherapy.com. We will endeavor to resolve your problem and reschedule the session free of charge. Should you suffer technical difficulties during the session, we will reschedule you free of charge for any session time you missed. In the event you are unable to connect to a session following direct contact with our technical support team, we will refund your money.

iCam Professional Services, Ltd. Software Licenses

Certain browsers require the use of iCam plug-in software. iCam Professional Services, Ltd. grants to you a non-exclusive, limited license to use iCam Professional Services, Ltd. plug-in software to conduct your video therapy session. This license is subject to the restriction that, except where expressly permitted by law, you may not translate, reverse-engineer or reverse-compile or decompile, disassemble or make derivative works from, iCam Professional Services, Ltd. software. You may not modify iCam Professional Services, Ltd. software or use it in any way not expressly authorized in these Rules. You agree and accept that iCam Professional Services, Ltd.’s introduction of various technologies may not be consistent across all platforms.

Warranty

MEMBER EXPRESSLY AGREES THAT THE USE OF iCam Professional Services, Ltd. SERVICES AND iCam Professional Services, Ltd. SOFTWARE ARE AT MEMBERS’ SOLE RISK. iCam Professional Services, Ltd. SOFTWARE, AND iCam Professional Services, Ltd. PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” FOR YOUR PERSONAL USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, UNLESS SUCH WARRANTIES ARE LEGALLY INCAPABLE OF EXCLUSION. iCam Professional Services, Ltd. PROVIDES THE iCam Professional Services, Ltd. SERVICE ON A COMMERCIALLY REASONABLE BASIS AND DOES NOT GUARANTEE THAT USERS WILL BE ABLE TO ACCESS THE SERVICE AT A TIME OR LOCATION OF THEIR CHOOSING, OR THAT IT WILL HAVE ADEQUATE CAPACITY FOR THE SERVICE AS A WHOLE OR FOR PARTICULAR PRODUCTS. iCam Professional Services, Ltd. ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY WITH RESPECT TO USE OF iCam Professional Services, Ltd., iCam Professional Services, Ltd. SOFTWARE, AND THE INTERNET SHALL BE THE REPLACEMENT OF ANY iCam Professional Services, Ltd. SOFTWARE FOUND TO BE DEFECTIVE. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, iCam Professional Services, Ltd.’S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW. iCam Professional Services, Ltd. DOES NOT ENDORSE, WARRANT OR GUARANTEE ANY PRODUCT OR SERVICE OFFERED THROUGH iCam Professional Services, Ltd., EXCEPT AS EXPRESSLY PROVIDED ELSEWHERE, AND WILL NOT BE A PARTY TO OR IN ANY WAY MONITOR ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.

Indemnification

User agrees to defend, indemnify and hold harmless iCam Professional Services, Ltd., its providers, affiliated companies, partners, its employees, contractors, officers, directors, telecommunications providers, ICPs from all liabilities, claims and expenses, including attorney’s fees, that arise from breach of the TOS by use of, or in connection with, the transmission of any Content on iCam Professional Services, Ltd. or the Internet by or through Members accounts. iCam Professional Services, Ltd. reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by Member hereunder. In such event, Member shall have no further obligation to provide indemnification for such matter.

Law

To the extent any conflict between this agreement and other rules exists, this agreement shall take precedence. If any part of the TOS is held invalid or unenforceable, that portion shall be construed consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions remain in full force and effect. The laws of the United Kingdom govern the TOS and your usage, however the laws applicable to the location of the provider at the time the service was delivered shall apply in the event the action is against the provider.
